A notice of clarification for public vigilance

The following pertains to the conference held on 24 Cheshvan about establishing a kevi’us; an established protocol for the complex process of writing and issuing Gittin in the city of Lakewood. Since human nature is such that credulous people tend to believe the rumors spread by those seeking to stir controversy, we have set out to state the facts as they are, to ensure that no one falls prey to rumormongers and that our intentions will always remain transparent and above reproach.

  • The idea of conducting this conference originated with HaGaon HaRav Yosef Shalom Elyashiv shlita, during a videotaped meeting that was held in his home at the end of the month of Sivan in 5769. He was astonished to hear that Gittin are being written in Lakewood without any kevi’us established by those Gedolim in America who are expert in these halachos. It was in accordance with his advice, encouragement, and with his specific guidance, that we gathered together to discuss this issue.

  • Those invited to discuss this issue at the conference were limited specifically to Roshei Batei Din and Dayanim who have extensive and multiyear experience in this challenging area of Halacha, and have an established reputation as Mesadrei Gittin for many years. This does not in any way preclude those who were not in attendance from stating their opinion on the matter discussed. Naturally, it is inevitable that this arena of Halacha will invite disagreements of opinion, both in interpretation and in application, and all who wish to state their opinions, are welcome to put pen to paper and thus express their opinions and reasons. This amicable manner of dispute was honorably practiced throughout the generations. When the occasion arose to make a kevi’us for the writing of Gittin in a town, all those qualified to do so came out with their teshuvos on the matter, each one advancing his own approach, until they finally reached a consensus. This process is evident in the teshuvos of the Noda BiYehudah, the Chasam Sofer, and others.

  • The purpose of the conference was not to establish a kevi’us for the writing of Gittin, but to discuss how to go about establishing the kevi’us. It goes without saying that the actual kevi’us will be determined with the participation of all the Gedolim and Rabbanim of the city.

  • At the conference, the first question discussed was whether this project raises any concern about being moitzi la’az — casting aspersions — on Gittin previously written in Lakewood. After all those present agreed unanimously that there is no concern of hotzo’as la’az, as stated in Teshuvos Maharil (104) and other sources, and that the aim of the conference is not to cast doubt on the Gittin that have already been written — only then did we proceed to discuss the actual question of how to go about establishing a kevi’us.

  • At the termination of the conference, a ruling was issued by HaGaon Harav Yechezkel Roth, the Gaavad of Karlsburg, joined by HaGaon HaRav Sariel Rosenberg, Av Beis Din under HaGaon HaRav Nissim Karelitz in Bnei Brak, and all the esteemed Rabbanim shlita, stating that no Gittin should be written in Lakewood for the time being until this matter is properly resolved.

In conclusion, this complex subject is not a recently uncovered problem; rather it is an old issue, long recognized by messadrei gittin both in Lakewood and outside the city. We are merely disciples at the feet of our sagely masters, seeking instruction on how to proceed. Any decisions regarding Gittin must, and will, remain in the hands of the Gedolei Haposkim to whom all of Klal Yisrael look for guidance in all matters pertaining to Halacha.

    The Lakewood Bdatz has a few serious problems & that's why they are all signing againsst them.
    They sy halacha is their only guide not politics.
    They will provide a "bimah-dan'tuni" aka "how did you arive at the psak"?
    They will give out a siruv against one that refuses to go to Bais Din & could get an outsider to write that he doesn't have to go.
    They refuse to succumb to $supporter$ of moi$doi$.
    In a Toirah shtut of Lakewood "kehn men nish tzu luzen, az min vaist nisht vehr iz der bal habusss".

    This is not a bashing site. just because we exercise freedom of speech and we dont fear the LKWD politicians, does not mean we allow personal attacks, or unsubstantiated allegations against anyone just because they may deserve it.
    We as whom it may be that posts an article, we do our research. Not always do we share our sources, for whatever reason may be.
    But if a commenter would like us to post something, he or she shall provide a source. If not it may be moderated or dismissed.

    I have now lost all respect for this site.
    I myself am a qualified Giitin Rabbi am in thre know that Knopfler is 100% wrong & a meirim yad betoras Moshe, & oiver on Cheirem Rishonim, I would advise the site to take this down. This isn't just Rosh Yeshiva hacking anymore, this is about calling tehoirim mamzeirim, & calling a Kosher yid a mamzer is very chomur, & has no kaporah ledoros.
    I was directed here by someone.
    You may ask why would he get Rabonim on his side the answer is simple, those Rabonim are not from Lakewood [none of them] and have no idea that gittin have been written in Lakewood for more than a decade.
    The fact that he shows maps of Lakewood doesn't alter the fact that a kvious mokoim was made when Knopfler [who also doesn't sign his name] was in diapers. At that time the Yishuv in Lakewood as Yidden from around the world knew it, was much smaller & concentrated within a square mile of the yeshiva. This frock clad mechutzaf turns up 20 years later in a different Lakewood, & is meorer on gittin that were written years back.
    Had those Rabonim known they would never have come, Reb Chazkel Roth Shlit"a has said that too.
    Knopfler needs fame, and is upset that a koil Koreh signed against him, hasn't come out, so this attention seeking sicko [who's only experience in Gittin is having given one], is going at it as hard as he can.
    Don't think for one minute there is a grain of leshem shomayim in his fight, he is simply a phsycopath.

    Your emotional rant is blatantly negated by the facts clearly stated in the letter written.
    Firstly, you attack an individual, whereas this clarification is presented by a Bais Din, which by very definition must consist of at least three people.
    Secondly, does the letter not state clearly that there is NO issue of hotza'as la'az?
    Doesn't this show clearly that no one is being called a mamzer or having a get paseled?
    If these Rabbonim don't know that gittin have already been written in Lakewood, why should their opening discussion have been about gittin already written in Lakewood, as the letter states clearly?
    Doesn't the letter state that Rav Elyashiv was the one who called for this?
    Is he also an attention seeking psychopath?

    I would think therefore, that if any one is guilty of casting aspersions on Gittin previously written, it is none other than your esteemed self. By ignoring the facts and just ranting like one who is politically prejudiced YOU are guilty of the very same crime you accuse another of doing.
    unless the Bais Dins clarification is blatantly false anyone reading what they write and what you write would be forced to state the the only person calling into doubt previous Gittin is yourself.
    Please take more care what you write.

    @3:47-You are a first class mechutzaf & motzei Laz on all of the Rabonim that sat at the conference, you don't come to their heels. Rav Yosef Sholom Eliyashev, Shlita has instructed that "the Rabonim of America" should sit together and decide How Gitten should be written in Lakewood.
    The Rabonim in Lakewood say they are NOT part of the recognozed Rabonim in America. They and @3:47 are the problem not the solution. You think it's Purim a gantz yuhr, put away the bottle already.

    The Roshei Yeshiva met this Shabbos in Chicago & decided that genug mitt dem "kinder-shpiel", we have to sit down & learn oif an emmes & say shiurim azoi vee Rav Shach, Z"L hut gezugut.

    No beis Din in history would remain anonymous on such a serious issue, there would be names signed.
    Anyone who knows a little history, would know that if Moron Hagri"sh called a meeting R" Chazkel Roth would never be there. [Whoever put out this letter must be to young to know].
    That said the letter is mezuyof mitoichoi.
    Third of all your assumptions that no one was koiveya mokoim al pi gedolei haposkim are simply not true. Reb Yankel Berman [who is a musmach legittin] was at Moron Hagri'Sh Shlita & has eidus of his haskomo.
    Had no gittin been written, [like this guy is claiming] on that kevius, rules on the ground may have changed since the yishuv in Lakewood which used to be concentrated in a square mile around the yeshiva has grown since then.
    all his taanos are gone seeing there was a kvias mokoim while this guy [who is not a musmach legitin not a beis din definately not a yochid mumcheh legittin] was still in his diapers.
    That said I don't care what he writes he is being motzi laaz al gittin.
    His whole game is to trash the Rabonim & Roshei Hayeshiva & show they have no power, it didn't work in Choshen Mishpot, so he moved to a very sensetive area, of being oiver on Cheirem Horishonim.
    BTW I am the Mr. qualified in gittin [above] you guys probably don't even know which chelek of Shulchan Aruch gittin is in.
